Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("Trader," "you," or "User") and Fundora Cap ("Fundora Cap," "we," "us," or "our") regarding your access to our website, evaluations, funded-account programs, dashboards, educational materials, community features, and related services (collectively, the "Services"). By creating an account, purchasing a challenge, requesting a payout, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, Risk Disclosure, Cookie Policy, and AML Policy.

If you do not agree, do not use the Services. We may update these Terms periodically. Material changes will be reflected by updating the date on this page and, where appropriate, by notifying account holders through the dashboard or email. Continued use after changes constitutes acceptance of the revised Terms.

For clarity in these Terms: "Challenge" means a paid evaluation product with defined rules and targets. "Funded Account" or "Funded Stage" means a post-evaluation simulated or demo trading environment in which eligible traders may generate profit-share rewards under program rules. "Program Rules" means the specific risk parameters, trading restrictions, and payout conditions applicable to your product. "Notional Balance" means the simulated account size shown in your dashboard and does not represent cash deposited with a broker in your name. "Reward" or "Payout" means a discretionary profit-share payment calculated under program rules after verification.

You must be at least eighteen (18) years old (or the age of majority in your jurisdiction) and legally able to enter contracts. You represent that you are not located in a comprehensively sanctioned jurisdiction and are not a prohibited person under applicable sanctions laws. You are responsible for providing accurate registration information and for keeping your credentials confidential. You are solely responsible for all activity under your account, including trades placed by APIs, Expert Advisors, or third parties you authorize.

We may refuse, suspend, or terminate accounts that appear fraudulent, abusive, underage, or in violation of these Terms or applicable law. One natural person should generally control one primary account unless we expressly approve otherwise. Creating multiple accounts to circumvent failed evaluations, KYC, or risk limits is prohibited and may result in forfeiture of pending rewards and permanent bans.

Fundora Cap provides proprietary trading evaluations and, where applicable, funded-style simulated accounts. Challenge and funded environments may use simulated or demo market conditions. Purchasing a challenge does not create a brokerage relationship, deposit of retail client funds with a regulated broker under your name, or entitlement to withdraw the notional account balance as cash.

Passing an evaluation may make you eligible for profit-share rewards according to program rules. Rewards are discretionary payouts based on simulated performance under our rules, not investment returns from client money. Nothing on our website constitutes an offer of employment as a proprietary trader at a traditional trading desk, investment advice, or a solicitation to deposit trading capital with Fundora Cap as a broker-dealer.

Challenge fees, account sizes, profit targets, drawdown limits, time rules (if any), consistency rules, news restrictions, and other parameters are disclosed at checkout and in the program documentation available on our Programs and How It Works pages. Fees are generally non-refundable once a challenge is activated or trading begins, except where required by law or expressly stated in a written promotion.

Reset fees, second attempts, account upgrades, and add-on products are optional and sold under separate checkout terms. Coupons and discounts may be revoked if used in bad faith, shared publicly in violation of campaign rules, or stacked against explicit restrictions. We may cancel orders that appear fraudulent, chargebacked without basis, or placed with stolen payment credentials.

Activation occurs when your evaluation account is provisioned and available for trading. If technical issues prevent activation within a reasonable period, contact Support; we will either activate the account, extend access, or provide a comparable remedy at our discretion.

You must follow the specific rules of your program, including but not limited to daily loss limits, maximum drawdown, consistency rules, news restrictions, EA/copy-trading policies, hedging policies, weekend holding rules, and lot-size or risk limits. Breaching rules may result in immediate failure of the challenge or funded stage without refund.

Prohibited conduct includes: exploiting platform latency or data feed errors; collusion between accounts; account sharing or credential sale; identity misrepresentation; using prohibited arbitrage strategies when disallowed; abusive, threatening, or harassing support behavior; reverse engineering or attacking our systems; scraping the site for competitive intelligence in violation of robots rules; and attempting to manipulate payouts through wash trading or coordinated gaming of consistency metrics.

We may review trade history, device fingerprints, IP patterns, and payment trails when investigating suspected abuse. Our determination that a rule was breached, made in good faith based on available data, is binding for account status purposes, subject to any review process we publish.

We may offer access through third-party platforms or proprietary terminals. Spreads, commissions, swap/financing, and available instruments are disclosed in product materials and may change. Simulated fills may differ from live brokerage fills. You accept that price feeds can lag, gap, or contain errors, and you must not trade solely to exploit obvious feed anomalies.

Scheduled maintenance, unexpected outages, and third-party platform incidents can interrupt trading. We are not liable for missed opportunities or losses arising from outages beyond our reasonable control, though we may, at our discretion, extend evaluation windows or provide account credits when prolonged outages materially impair fair evaluation conditions.

Profit-share payouts are processed according to the schedule and methods shown in your dashboard (for example crypto wallet withdrawals). We may require identity verification (KYC), proof of address, source-of-funds information, or additional documentation before the first or subsequent payouts. We may delay, reduce, or deny payouts where we reasonably suspect fraud, rule breaches, sanctions risk, or AML concerns.

You must ensure withdrawal destinations are under your control. Requests to send rewards to unrelated third parties may be refused. You are responsible for taxes on amounts you receive. Fundora Cap does not provide tax, legal, or accounting advice. Keep your own records of rewards received.

All trademarks, logos, software, content, designs, blog articles, and documentation on the Services are owned by Fundora Cap or its licensors. You receive a limited, revocable, non-transferable license to use the Services for personal evaluation purposes. You may not copy, scrape, mirror, or commercially exploit our content without written permission, except for fair use of publicly available marketing materials with attribution.

If you join Discord, Telegram, or other community channels linked from Fundora Cap, you must follow community guidelines. We may remove posts that promote scams, doxxing, hate speech, or competitor spam. Transactional emails (receipts, security alerts, payout notices) are part of the Service. Marketing emails are sent only where permitted by law and your preferences; you may unsubscribe via the link in those emails.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted uptime, error-free price data, that you will pass any challenge, or that you will receive any payout. Educational content on our blog is informational only and not personalized advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDORA CAP'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE FEES YOU PAID TO US FOR THE SPECIFIC CHALLENGE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE EVENT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST TRADING OPPORTUNITIES, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.

You agree to indemnify and hold harmless Fundora Cap and its officers, employees, contractors, and partners from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Services, violation of these Terms, violation of law, or infringement of third-party rights.

We may suspend or terminate access for rule breaches, unpaid chargebacks, abusive conduct, legal risk, or prolonged inactivity. You may close your account by contacting Support, subject to completion of pending KYC or dispute processes. Provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) survive termination.

These Terms are governed by the laws specified in our company registration documents, without regard to conflict-of-law principles. Disputes should first be raised to Support with a clear description and supporting evidence. Binding arbitration or courts of competent jurisdiction may apply as required by your local consumer laws. Nothing in these Terms limits non-waivable consumer rights.

We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, terrorism, labor disputes, utility failures, cyberattacks, or government actions.

These Terms, together with program rules and policies referenced herein, constitute the entire agreement regarding the Services and supersede prior conflicting statements. If any provision is held unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver.
